Gebruiksvoorwaarden

Please carefully read these terms of use (“Gebruiksvoorwaarden”) and Privacyverklaring before using our or our affiliates’ websites and any services made available by us or our affiliates via our website(s) (collectively, the “Site”) . These Gebruiksvoorwaarden govern your use of the Site. By accessing, using, downloading, or logging into the Site, you agree to these Gebruiksvoorwaarden and you represent that you are of legal age to agree to these Terms of Use, and the Privacyverklaring.

We may change these Terms of Use at any time in our sole discretion without prior notice. Any changes to these Terms of Use will be in effect as of the “Laatst bijgewerkt” date referenced above. If you do not agree naar de changes, you shall immediately stop using or logging into the Site. 

We and our affiliates offer a wide variety of products and services that require additional terms and conditions. Your use of those  products and services provided by us or our affiliates  are pursuant to a separate agreement (“Algemene voorwaarden overeenkomst”). De General Terms Agreement  forms part of your agreement with us or our affiliates (as applicable). If these Terms of Use are inconsistent with the General Terms Agreement with respect to those products and services, the General Terms Agreement will control.

Toegang tot en gebruik van de site
When you access or use the Site, you agree to use the Site only for purposes that are permitted by these Terms of Use and any applicable law, regulation, or generally accepted practices or guidelines in relevant applicable jurisdictions. Also, you agree that you are solely responsible for any breach of your obligations under these Terms of Use and for the consequences of any such breach. 

Als voorwaarde voor het gebruik van de Site, garandeer je ons dat je de Site niet zult gebruiken voor enig doel dat onwettig is of anderszins verboden door deze Gebruiksvoorwaarden. Of het nu namens uzelf is of namens een derde, u stemt ermee in om niet:

Om toegang te krijgen tot bepaalde diensten, functies, onderdelen of inhoud op de Site, kan het nodig zijn een account aan te maken en een wachtwoord op te geven. Om een account aan te maken, moet u ten minste 18 jaar oud zijn en moet u volledige en nauwkeurige informatie verstrekken. U mag zich niet voordoen als een persoon of entiteit in verband met de Site of uw account. Als uw gegevens op enig moment wijzigen, is het uw verantwoordelijkheid om uw account bij te werken om deze wijzigingen weer te geven.

Tenzij uitdrukkelijk toegestaan onder deze Gebruiksvoorwaarden, mag u uw account met niemand anders delen. U bent verantwoordelijk voor het handhaven van de vertrouwelijkheid van en het voorkomen van onbevoegd gebruik van uw accountgegevens en voor alle activiteiten die plaatsvinden onder uw account. Wij behouden ons het recht voor om uw account op elk moment op te schorten, uit te schakelen, te deactiveren of te blokkeren. Wanneer u een Algemene Voorwaarden Overeenkomst bent aangegaan, zullen wij dit doen in overeenstemming met de Algemene Voorwaarden Overeenkomst.

Except as may otherwise be provided, the Site and the content included in or made available through the Site, such as text, graphics, logos, images, sounds, videos, digital downloads, data compilation, software, and documents, are our exclusive property and/or that of our licensors and content providers, and are protected by international intellectual property laws. All rights, title and interest not expressly granted with respect to the Site and content provided on or made available through the Site are reserved and retained by us and our licensors and content providers.

Where we or our affiliates collect information about you on a Site, this is subject to the Privacyverklaring.

De Site kan links bevatten naar websites van derden. Dat betekent niet dat wij die websites controleren of goedkeuren, of goederen of diensten die op die websites worden verkocht. De Site kan ook advertenties van derden bevatten. Wij controleren of onderschrijven geen producten waarvoor reclame wordt gemaakt. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS SITE OR THE INFORMATION, CONTENT, MATERIALS, PROGRAMS, OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE, UNLESS OTHERWISE SPECIFIED IN WRITING. THE SITE IS MADE AVAILABLE  ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE GREATEST EXTENT PERMITTED UNDER APPLICABLE LAW, WE AND OUR AFFILIATES EXPRESSLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT WITH RESPECT TO THE SITE AND ALL INFORMATION, CONTENT, MATERIALS, PROGRAMS, OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE.

Beperking van aansprakelijkheid voor de site 

TO THE GREATEST EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, AGENTS, OR SERVICE PROVIDERS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR ANY DAMAGES OF ANY KIND ARISING FROM YOUR ACCESS OR USE OF THE SITE OR ANY THIRD PARTY’S USE OF THE SITE. IF YOU HAVE A SEPARATE GENERAL TERMS AGREEMENT WITH US, THE PROVISIONS OF THAT AGREEMENT MAY ALSO APPLY. 

Op deze Gebruiksvoorwaarden en eventuele geschillen op grond van deze Gebruiksvoorwaarden of de Site is Nederlands recht van toepassing, ongeacht conflicterende rechtsregels. U stemt er uitdrukkelijk mee in dat de rechtbanken in Amsterdam, Nederland exclusieve jurisdictie hebben voor enige claim of geschil op grond van deze Gebruiksvoorwaarden en/of uw gebruik van de Site. Voor zover toegestaan onder het toepasselijk recht, komen u en wij overeen dat geen van beide partijen een geschil aanhangig kan maken als eiser of lid van een class action.

Extra details
If you do not comply with these Terms of Use, and we do not take immediate action, that does not mean we or our affiliates are giving up any rights we may have to take action in the future.

If it turns out that a particular provision in these Terms of Use is not enforceable or valid, that will not affect any other provision in these Terms of Use. 

Wij behouden ons het recht voor om de Site op elk gewenst moment te wijzigen zonder je daarvan op de hoogte te stellen. Wij kunnen bijvoorbeeld functionaliteiten of functies aan de Site toevoegen of verwijderen, of wij kunnen een bepaalde functie of de Site in zijn geheel opschorten of stoppen. We behouden ons ook het recht voor om op elk gewenst moment kosten in rekening te brengen voor functies op de Site. Als wijzigingen je niet bevallen, kun je op elk moment stoppen met het gebruik van de Site.
